'**VIOLATIONS: 1) Delivering water with a concentration of combined radium-226 and radium- 228 exceeding 5 pCi/1; and 2) Delivering water with a concentration of gross alpha particle activity (including radium-226 but excluding radon and uranium) exceeding 17 pCi/1. **RELIEF SOUGHT: 1) Collect and analyze quarterly samples for gross alpha particle activity, radium-226, and radium-228 at thecollection point until the annual average concentration no longer exceeds the maximum contaminant level (mcl), or until a monitoring schedule as a condition to a variance or exemption shall become effective; 2) Provide public notice every three months as long as the gross alpha particle, radium-226, and radium-228 violations persists; 3) Within 90 days, provide NMED a detailed plan and schedule for complying with all parts of this ao; and 4) Within three years, provide that water being delivered into distribution of the Fort Sumner Municipal Water system containing levels below the concentration of combined radium-226 and radium-228 of 5 pCi/1 picocuries per liter (pCi/1) and gross alpha particle activity (including radium-226 but excluding radon and uranium) of 15 picocuries per liter (cPi/1).
