Unilateral Administrative Order Without Adjudication

Case summary

In entering into this order, the mutual objectives of EPA and the Respondent are to identify, investigate, contain and stop migration of COCS, above remediation goals, into the Inner Harbor Ship Channel, and remediate hazardous wastes, hazardous constituents, hazardous substances and/or solid wastes that have been released, as of the effective date of this Order, to the environment on or under the facility, and to ensure that corrective action activities deemed necessary by EPA are designed and implemented to protect human health and the environment. This Order requires respondent to: (1) perform Interim/Stabilization Measures at the facility: (2) conduct a Facility investigation and conduct a Corrective Measures Study; and (3) implement the corrective measure or measures as required. This order also requires the respondent to: a) provide access to the facility for performance of tasks by Coastal Pursuant to to the Coastal order; b) cooperate with Coastal's actions under the Coastal Order; and c) to accept and manage recovered ground water from the facility containing specified concentrations of Chromium constituents after treatment by Coastal.
