Case summary

ReMuriate Delta, LLC owns and operates a hydrochloric acid regeneration facility in Delta, Ohio. Following an inspection of the facility in June 2022, EPA alleged that ReMuriate failed to meet the emission limits for hydrochloric acid, chlorine, and particulate matter and failed to conduct visible emission monitoring, in violation of its operating permit. EPA has entered into a Consent Agreement and Final Order (CAFO) and an Administrative Compliance Order (ACO) with ReMuriate to resolve the alleged violations. Under the ACO, EPA will create an SOP and training for visible emission monitoring, operate the stack separator system in accordance with the most recent compliant stack test, submit a permit application include operating parameters developed during the most recent compliant stack test, develop an Operation and Maintenance Plan for the stack separator equipment, and conduct a performance test of the scrubber system. Under the CAFO, ReMuriate will pay a penalty of $302,109.20.
