Case summary
A Consent Agreement and Final Order (CAFO) for Detroit Diesel Corporation, Detroit, Michigan to address violations regarding the Michigan State Implementation Plan (SIP), at R 336.1301(1)(a), and conditions of its 2022 Air Permit. Specifically, Detroit Diesel Corporation violated the Michigan SIP opacity limit of a 6-minute average of 20% opacity, except for one 6-minute average per hour of not more than 27% opacity, and failed to report opacity limit exceedances in its semi-annual deviation report for July 2023 through December 2023. We discovered these violations through a Section 114 Information Request, in which Detroit Diesel installed a continuous opacity monitoring system on its diesel engine test cell stack for 30 days in accordance with EPA Performance Specification 1, and through obtaining Detroit Diesel?s latest semi-annual deviation report from Michigan EGLE. A concurrent ACO has been agreed to by Detroit Diesel and is currently being routed for signature and approval. This CAFO requires Detroit Diesel to pay a penalty of $125,397 and resolves the NOV issued to Detroit Diesel on April 16, 2024.
