Case summary

Region 5 will enter into a Consent Agreement and Final Order (CAFO) for Rockies Express Pipeline LLC (REXP), Ashville, Ohio to resolve violations regarding the New Source Performance Standards (NSPS) for Crude Oil and Natural Gas Facilities for which Construction, Modification, or Reconstruction Commenced After September 18, 2015 and On or Before December 6, 2022 (Subpart OOOOa). Subpart OOOOa requires that leaking fugitive emissions components be repaired during the next scheduled compressor station shutdown for maintenance, scheduled well shutdown, scheduled well shut-in, after a scheduled vent blowdown, or within 2 years of detecting the fugitive emissions, whichever is earliest. REXP detected a leak on a compressor o-ring seal on January 5, 2022 at its Columbus Compressor Station in Ashville, Ohio. As of April 18, 2024, the leak had still not been repaired, in violation of Subpart OOOOa requirements at 40 C.F.R. ?60.5397a(h)(3)(i). On September 9, 2024, Region 5 issued a Finding of Violation to REXP. In discussions with the company on October 23, 2024, about the FOV, REXP notified EPA that it had repaired the leaking o-ring seal on October 11, 2024. REXP has come into compliance so there is no corresponding ACO. This CAFO requires REXP to pay a penalty of $36,777 and resolves the FOV issued to REXP on September 9, 2024.
