Case summary

EPA Region 5 will enter into a Consent Agreement and Final Order (CAFO) with Rowell Chemical Company (Rowell), Willow Springs, Illinois to resolve violations of provisions of its Federally Enforceable State Operating Program (FESOP) that is applicable to Rowell?s asphalt loading and storage facility. Specifically, Rowell violated Provision 10.a. of its FESOP, which requires Rowell to take appropriate and necessary actions to minimize odors, including but not limited to, changes in raw material or installation of controls, in order to eliminate the odor nuisance. Rowell has also agreed to enter into a concurrent Administrative Compliance Order to memorialize actions Rowell is taking to minimize odors, including but not limited to use of an ?ECOSORB? system. This CAFO requires Rowell to pay a penalty of $27,000 and resolves the NOV issued to Rowell on March 30, 2023.
