Case summary

EPA Region 5 will enter into an Administrative Consent Order (ACO) for Rowell Chemical Company (Rowell), Willow Springs, Illinois to address violations regarding the Illinois State Implementation Plan (SIP). Specifically, Rowell owns an inorganic chemical and asphalt storage and distribution facility in Willow Springs, Illinois. The Willow Springs facility had a history of odor complaints from local citizens and EPA detected asphalt odor downwind of Rowell?s asphalt tanks during an inspection on October 19, 2022. On March 30, 2023, Region 5 issued to Rowell a Notice of Violation alleging that Rowell had failed to take appropriate and necessary actions to minimize odors, as required by its Federally Enforceable State Operating Permit (FESOP) issued under the Illinois SIP. This ACO requires Rowell to install and use an odor reduction system and make periodic reports to EPA regarding its use. These actions will address the violations set forth in the NOV issued to Rowell on March 30, 2023. Rowell will also enter into a CAFO with Region 5 to resolve the violations in the March 30, 2023 NOV. Under the terms of the CAFO, Rowell will pay a penalty of $ 27,000.
