EPA v. ALCO NVC, INC - APO/CAFO
Final Order With Penalty
Case summary
Consent Agreement and Final Order (CAFO) for Alco Products, LLC (Alco), Detroit, Michigan to resolve violations regarding Standards of Performance (NSPS) for Asphalt Processing and Asphalt Roofing Manufacture, 40 C.F.R. Part 60, Subpart UU (NSPS UU) and the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Area Sources: Asphalt Processing and Asphalt Roofing Manufacturing, 40 C.F.R. Part 63, Subpart AAAAAAA (NESHAP 7A). In 2024, EPA alleged that ALCO had violated both standards, most notably by exceeding opacity emission limits at two silos. ALCO will pay a penalty of $150,000 to resolve these violations, in addition to entering into an Administrative Consent Order (ACO). The ACO requires ALCO to implement its EPA-approved monitoring plan, apply for a permit revision to make that plan enforceable beyond the ACO, and continuously operate control devices at the facility.
