Case summary
EPA will enter into an Administrative Consent Order (ACO) for Becker Iron and Metal, Inc. (Becker), Venice, Illinois to address violations regarding the regulations for the Protection of Stratospheric Ozone found at 40 C.F.R. Part 82, Subpart F (Subpart F). Specifically, Becker failed to recover refrigerants, or verify refrigerants were properly recovered, from small appliances that it accepted for recycling at its facility in Venice, Illinois. Becker did not maintain work practices that are required by Subpart F to prevent the release of ODS and substitutes to the atmosphere during recycling of small appliances. This ACO requires Becker to develop and implement a refrigerant management plan, recover refrigerant from appliances containing refrigerant when delivered to Becker?s facility and verify using a signed statement or contract that refrigerant was properly recovered from appliances arriving at Becker?s facility empty of refrigerant. Becker must also notify its suppliers of the conditions under which Becker may accept appliances, and periodically report to EPA. These actions address the violations set forth in the FOV issued to Becker on February 26, 2024. Becker will enter into a concurrent CAFO which requires payment of a $98,784 penalty.
