Case summary

Pest Fog is a fumigation supply business and an importer and distributor of methyl bromide who failed to report imports and other recordkeeping requirements to EPA as required under 40 C.F.R ? 82.13(g)(4) between at least August 2020 and July 2023. Methyl bromide is a Class I ozone-depleting substance and also a potent neurotoxin. Reporting regulations require distributors to track quantities of methyl bromide sold and obtain certification from customers that the material will be used only for quarantine and preshipment applications. The regulations also require importers of methyl bromide not to be used for quarantine and preshipment applications to obtain allowances to import. Pest Fog did not obtain such allowances for one shipment of methyl bromide. This CAFO requires Pest Fog to pay a penalty of $116,826 and resolves the FOV issued to Pest Fog on May 30, 2024.
