Case summary

Gold Medal Service (GMS) is a heating, air-conditioning, electrical, and plumbing service business. Among other things, GMS performs repairs and replacements of home air conditioning systems, and are subject to 40 CFR Part 82, Subpart F which in part requires technicians evacuating refrigerant from appliances with a full charge of more than 5 and less than 50 pounds of refrigerant for purposes of disposal of that appliance to keep records of the amount and type of refrigerant recovered and documentation that it was sent for proper disposal or reclamation. The purpose of this requirement is to ensure that refrigerant is not vented to the atmosphere during disposal of appliances. On February 1, 2024, EPA issued to GMS a finding of violation alleging that it violated the repair requirements of 40 C.F.R. Part 82, Subpart F by failing to keep required records of appliance and refrigerant disposal. This CAFO requires GMS to pay a penalty of $101,295 and resolves the FOV issued to GMS on February 1, 2024. GMS is concurrently entering into an ACO to address compliance with Subpart F.
