Case summary
Nalco Production LLC (NP) is the owner of a polymer blend manufacturing facility and Nalco Company LLC (NC) is the operator of the Facility. The Facility is located in a potential Environmental Justice area of concern. The Facility uses Epichlorohydrin and Dimethylamine to manufacture chemicals and is subject to Chemical Accident Prevention Provisions, 40 C.F.R. Part 68. On October 25 and 26, 2021, EPA conducted an announced inspection at the Facility. On June 30, 2022, EPA issued a Finding of Violation (FOV) to NP and NC. The issued consent agreement and final order (CAFO) resolves civil penalties for alleged violations of hazard assessment, process safety information, process hazard analysis, operating procedures, mechanical integrity, incident investigation, contractor and risk management plan requirements. EPA issued concurrently an administrative consent order (ACO) to ensure the Respondent has returned to compliance with all the requirements of Part 68.
