Case summary

U.S. EPA Region 5 and Metalico Youngstown, Inc. (Metalico) have reached a settlement that resolves alleged violations of the Clean Air Act by requiring Metalico to fully achieve, demonstrate, and maintain compliance with the Act at its facility located at 27 Furnace Lane, Girard, Ohio and to pay a civil penalty. Metalico operates a metal shredder at its Ohio facility, that processes scrap automobiles and other scrap metal materials. On July 29, 2024, EPA issued a Notice and Finding of Violation (NOV/FOV) to Metalico alleging that the company failed to obtain a Title V permit despite operating the shredder with an unlimited potential to emit over 100 tons of VOC per year, in violation of Title V of the Clean Air Act. The NOV/FOV also alleges that Metalico failed to obtain a permit that requires Best Available Technology for controlling VOC, in violation of the Ohio State Implementation Plan. EPA has now entered into an Administrative Consent Order (ACO) with Metalico and filed a Consent Agreement and Final Order (CAFO) to resolve these alleged CAA violations. The ACO requires Metalico to submit an application to Ohio EPA for a federally enforceable permit that limits the shredder?s VOC emissions below the major source threshold, limits scrap throughput in conjunction with the VOC limit, requires work practices for minimizing VOC emissions, and requires Metalico to institute staff training for the work practices. The CAFO requires Metalico to pay a penalty of $25,000.
