Case summary
Marathon Petroleum Company LP, Canton, Ohio (MPC) violated the Ohio SIP, NSPS for Petroleum Refineries, NSPS for Petroleum Refineries for Which Construction, Reconstruction, or Modification Commenced After May 14, 2007, and NESHAP for Petroleum Refineries: Catalytic Cracking Units, Catalytic Reforming Units, and Sulfur Recovery Units. MPC violated the 250 ppm SO2 NSPS and NESHAP emission limit at its sulfur recovery unit (SRU) for 247 hours between December 23, 2022 and July 14, 2023. During the same period, MPC exceeded the SO2 mass emission rate specified for the SRU pursuant to the Ohio SIP for 403 hours. Additionally, MPC exceeded the 162 ppm H2S NSPS limit for fuel gas combustion devices for 73 hours between August 6, 2022 and May 27, 2023. Lastly, MPC violated NSPS excess emission reporting requirements. EPA and MPC agreed to a penalty based on the Clean Air Act Stationary Source Penalty Policy of $225,715. A concurrent ACO will require MPC to comply with the NSPS for Petroleum Refineries for Which Construction, Reconstruction, or Modification Commenced After May 14, 2007 for the SRU and for fuel gas combustion devices that were constructed on or before May 14, 2007. MPC must also develop and implement a plan, subject to EPA approval, for operating and maintaining SRU emissions controls in accordance with its obligation to minimize emissions.
