EPA Region 5 is entering into a Consent Agreement and Final Order with Garden Street Iron and Metal, Inc. (Garden Street), Cincinnati, Ohio to resolve violations of the regulations regarding the Protection of Stratospheric Ozone, at 40 C.F.R. Part 82, Subpart F. Region 5 inspected Garden Street?s scrap metal recycling facility on March 20, 2019 and reviewed records to assess compliance. Region 5 alleged that Garden Street failed to verify with signed statements that refrigerant had been properly recovered from small appliances and motor vehicle air conditioners prior to accepting them for recycling and failed to notify suppliers of appliances and motor vehicle air conditioners of the requirement to properly recover refrigerant before delivery. EPA issued a Finding of Violation to the company on June 6, 2019. EPA filed an Administrative Complaint, Docket Number CAA-05-2024-0029, on February 29, 2024. The CAFO requires Garden Street to pay a penalty of $150,000 and resolves Administrative Complaint CAA-05-2024-0029.
