Case summary
On November 19, 2019, EPA issued a Section 208 information request to Calibrated. Calibrated?s response to EPA included Calibrated?s GM 2001-2010 Ace, Jack, and King ECM tuning products as having the capability to bypass, defeat, or render inoperative devices or elements of design installed on or in motor vehicles or motor vehicle engines in compliance with Title II of the CAA. In addition, EPA found that Calibrated knowingly removed and/or rendered inoperative devices or elements of design installed in or on motor vehicles or motor vehicle engines in compliance with the CAA by installing or modifying software on ECMs installed on or in at least 1 motor vehicle. On July 7, 2021, EPA issued a Finding of Violation (FOV) to Calibrated alleging violations of Section 203(a)(3)(A) and (B) of the CAA, 42 U.S.C. ? 7522(a)(3)(A) and (B), related to the manufacture, sale, and/or installation of ECM tuning products. This CAFO requires Calibrated to pay a penalty of $125,302 and complete a supplemental environmental project, replacing at least 2 Woodstock Consolidated School District older school buses and resolves the FOV issued to Calibrated on July 7, 2021.
