Case summary
I recommend that you approve the attached Administrative Consent Order (ACO) for A & R Custom Chrome, Chicago, Illinois to address violations regarding National Emission Standards for Hazardous Air Pollutants (?NESHAP?) for Chromium Emissions From Hard and Decorative Chromium Electroplating and Chromium Anodizing Tanks, 40 C.F.R. ?? 63.340?63.348. Specifically, the ACO alleges that A&R Chrome failed to: (1) sufficiently control emissions discharges; (2) stop using a PFOS-based fume suppressant after September 21, 2015; (3) physically separate buffing, grinding, and/or polishing operations from chromium electroplating tanks; (4) conduct an initial performance test; (5) measure surface tension according to the required schedule; (6) maintain certain records; and (7) submit a notification of compliance status to EPA. A CAFO will also be finalized concurrently with the ACO that requires A&R Chrome to pay a civil penalty of $500. This ACO requires A & R Custom Chrome to: (1) submit a notification of compliance status; (2) develop a recordkeeping template to track hours operated and surface tension tests and results; (3) submit an updated operating and maintenance plan; (4) monitor surface testing at least quarterly; and (5) submit quarterly records to EPA. These actions will address the violations set forth in the FOV issued to A & R Custom Chrome on September 26, 2022.
