Case summary

Lakeshore failed to properly monitor and record net heating values for vent gas to the flare during pressurized rail tank car purging/degassing operations; failed to maintain the minimum standard of 200 BTU/scf for each one-hour rolling average of the net heating values of the vent gas to the flare, during entire periods of time when emissions were vented to the flare; and failed to apply for a permit modification. These were all requirements of a 2016 ACO, which had not terminated since the company never was in full compliance with its terms, and all the requirements had basis in the Indiana SIP and the facility's 2009 FESOP. The facility has terminated the pressurized rail tank car purging/degassing operations on site and is no longer operating the flare associated with the operation. Resultingly, there is no concurrent ACO with this matter. This CAFO requires Lakeshore to pay a penalty of $153,000, and resolves the NOV/FOV issued to Lakeshore on July 12, 2021.
