EPA v. ECOLOGY TECH DBA S & S METAL RECYCLERS II - ACO

Case summary

EPA Region 5 will enter into an Administrative Consent Order (ACO) with Ecology Tech d/b/a S&S Metal Recyclers II (Ecology Tech) located in Aurora, Illinois to address violations of 40 CFR ? 82.155 Safe disposal of appliances. Ecology Tech was accepting small appliances from peddlers without recovering refrigerant, entering into a contract or getting a signed statement. Ecology Tech had signage posted stating that they don't accept appliances with refrigerant which encourages improper venting. Ecology Tech agreed to start recovering refrigerant on site, inform their customers that they are recovering refrigerant and rejecting appliances with cut lines, and keeping a log of rejected appliances. Ecology Tech must: -notify its suppliers in writing that it will not accept small appliances, MVACs, or MVAC-like appliances with cut or dismantled refrigerant lines, unless the suppliers certify that the refrigerant was properly recovered; -notify peddlers that Ecology Tech recovers refrigerant on site; -remove all signs at the Facility that indicate that refrigerants and CFCs are not accepted; -retain copies of receipts for all refrigerant it collects and sends to another company for reclamation or destruction; -using a log, document the number of small appliances, MVACs, or MVAC-like appliances it accepts, evacuates, and rejects, the date the appliance was accepted/evacuated/rejected; -develop and follow a written refrigerant management plan and train its employees on it Every six months, Ecology Tech must submit: -any completed signed statements and contracts used; -the log they are required to keep. An agreement on penalty has not yet been reached but is being negotiated.
