EPA v. RENERGY - DOVETAIL ENERGY LLC
Final Order With Penalty
Case summary
.Renergy owns two anaerobic digestion facilities (Dovetail Energy, LLC and Emerald BioEnergy, LLC) that generate biogas for electricity production. The facilities take in manure and food waste as feedstock for the digesters. Renergy violated conditions of its federally enforceable permit including the failure to meet hydrogen sulfide limits, sulfur dioxide limits, and minimum heat content requirements; failure to send digester gas to the flare when the engine was not in operation; failure to request authorization from the permitting authority to shut down the flare while operating the digester, and failure to report deviations in an annual permit evaluation report. Renergy intends to sell the assets that comprise the Emerald and Dovetail facilities. In the settlement of this case, Renergy (or, upon the sale of the closing dates, the purchasers) will be required to use supplemental gas when the methane content of the biogas is deficient, to maintain sufficient combustion equipment capacity on-site, to conduct biogas leak monitoring, to maintain a spare parts inventory, and to ensure proper hydrogen sulfide treatment and recordkeeping. Renergy made a claim of inability to pay a civil penalty. After a financial analysis conducted by a contractor, the parties agreed to a civil penalty of $15,000.
