Case summary
Region 5 issued a FOV to IAWC on September 13, 2021 alleging that IAWC violated provisions of the Chemical Accident Prevention Provisions (CAPP) pertaining to management, hazard assessment, the Program 3 prevention program, and emergency response. We discovered these violations during an announced inspection conducted on June 20, 2019, where upon numerous documents were provided by IAWC and reviewed by EPA. Prior to settlement, IAWC promptly returned to compliance with the CAPP, therefore, no ACO was warranted. This CAFO requires IAWC to pay a penalty of $59,427 and resolves the FOV issued to IAWC.
