Case summary

On August 25, 2023, EPA requested U.S. CBP to refuse admission of a shipment of unregistered pesticides. EPA determined that the quantity of Clorox Toilet Bowl Cleaner, Clorox Clean-Up Spray, and Clorox All-Purpose Cleaner within the shipment were not registered under FIFRA. Further, neither the Notice of Arrival of Pesticides and Devices (NOA), EPA Form 3540-1, or its electronic equivalent in the Automated Commercial Environment (ACE) was submitted for the shipment. The importation of an unregistered pesticide is a violation of Section 12(a)(1)(A) of FIFRA. The failure to submit the NOA or its electronic equivalent is a violation of Section 12(a)(2)(N) of FIFRA.
