Case summary

On July 26, 2023, EPA requested U.S. CBP refuse admission of an import shipment of Clorox Disinfecting Bathroom Cleaner . EPA determined that the quantity of Clorox Disinfecting Bathroom Cleaner contained within the import shipment was not registered under FIFRA. The distribution or sale, including importation, of an unregistered pesticide is an unlawful act under Section 12(a)(1)(A) of FIFRA, 7 U.S.C. 136j(a)(1)(A). In addition, a Notice of Arrival (NOA) was not submitted prior to the arrival of the shipment into the United States, as required by Section 17 of FIFRA and 19 C.F.R 12.112(a). Failure to submit an NOA prior to the arrival of a pesticide product into the United States is a violation of Section 12(a)(2)(N) of FIFRA, 7 U.S.C. 136j(a)(2)(N).
