Case summary

On July 21, 2023, EPA requested U.S. Customs and Border Protection (CBP) to Refuse Admission of an unregistered pesticide. EPA determined that the quantity of Lysol Laundry Disinfectant contained within the import shipment was unregistered. Pesticidal claims were observed on the label of Lysol Laundry Disinfectant. The distribution or sale of an unregistered pesticide, including the importation of such pesticide, is an unlawful act under Section 12(a)(1)(A) of FIFRA, 7 U.S.C.136j(a)(1)(A). In addition, a Notice of Arrival (NOA) was not submitted for the shipment prior to its June 19, 2023, arrival into the United States, as required by Section 17 of FIFRA and 19 C.F.R. 12.112(a). Failure to submit an NOA prior to the arrival of the pesticide product Lysol Laundry Disinfectant into the United States is a violation of Section 12(a)(2)(N) of FIFRA, 7 U.S.C. 136j(a)(2)(N).
