EPA v. Seduxtion (NORA)

Case summary

On July 21, 2023, EPA requested the U.S. Customs and Border Protection (CBP) to Refuse Admission of an unregistered pesticide. EPA determined that the quantity of Antimicrobial Toy Cleaner contained within the import shipment was not registered under FIFRA. The distribution or sale, including importation, of an unregistered pesticide is an unlawful act under Section 12(a)(1)(A) of FIFRA, 7 U.S.C. 136j(a)(1)(A). In addition, a Notice of Arrival (NOA) was not submitted for the shipment prior to its July 19, 2023 arrival into the United States, as required by Section 17 of FIFRA and 19 C.F.R 12.112(a). Failure to submit an NOA prior to the arrival of a pesticide product into the United States is a violation of Section 12(a)(2)(N) of FIFRA, 7 U.S.C. 136j(a)(2)(N).
