Case summary

On June 1, 2023, EPA requested the U.S. Customs and Border Protection Refuse Admission of an unregistered pesticide. Based on the information provided to EPA by CBP, EPA determined that the quantity of Lysol Disinfectant Spray is not registered under FIFRA. Further, neither the Notice of Arrival of Pesticides and Devices (NOA), EPA Form 3540-1, or its electronic equivalent in the Automated Commercial Environment (ACE) were submitted. The importation of an unregistered pesticide is a violation of Section 12(a)(1)(A) of FIFRA. The failure to submit the NOA or its electronic equivalent is a violation of Section 12(a)(2)(N) of FIFRA.
