EPA determined that the quantity of Kiki Pure A2 Air Purifier, contained within the import shipment is misbranded. The pesticide device label provided by the Importer of Record and uploaded into ACE included the EPA logo, which is considered false or misleading under 40 C.F.R. 156.10(a)(5)(v). The distribution or sale of a misbranded device, including the importation of such device, is an unlawful act under Section 12(a)(1)(F) of FIFRA, 7 U.S.C. 136j(a)(1)(F).
