On April 18, 2023, EPA requested U.S. CBP refuse admission of a shipment containing Walter's Disinfecting Wipes. Based on the information provided to EPA by CBP, EPA determined that the quantity of Walter's Disinfecting Wipes was not registered under FIFRA. Further, neither the Notice of Arrival of Pesticides and Devices (NOA), EPA Form 3540-1, or its electronic equivalent in the Automated Commercial Environment (ACE) was completed for the shipment. The importation of an unregistered pesticide is a violation of Section 12(a)(1)(A) of FIFRA. The failure to submit the NOA or its electronic equivalent is a violation of Section 12(a)(2)(N) of FIFRA.
