On October 17, 2022, EPA requested the U.S. Customs and Border Protection Redeliver and Refuse Admission of an unregistered pesticide. EPA determined that the quantity of Dimefluthrin TG and Dimefluthrin were not registered under FIFRA. Further, the broker, on behalf of the importer, confirmed the quantities of imefluthrin TG and Dimefluthrin were not labeled. As such, EPA determined that these unregistered pesticides do not qualify for an exemption from registration under FIFRA for products intended for research and development use, 40 C.F.R. 152.30(c). The importation of an unregistered pesticide is a violation of Section 12(a)(1)(A) of FIFRA.
