Case summary

Region 5 filed a Consent Agreement and Final Order (CAFO) commencing and concluding an administrative matter under Section 205(c)(1) of the Clean Air Act (CAA) with DNR Customs, LLC (DNR), a corporation that provides repair services for diesel trucks in Casco, Michigan. The CAFO alleges that DNR violated Section 203(a) of the CAA both by selling and/or installing so-called aftermarket defeat devices, i.e. parts or components that bypass or defeat a motor vehicle engine?s original design to comply with CAA emission standards, and by removing or rendering inoperative devices that were installed by the original manufacturer in order to comply with CAA emission standards. Pursuant to the CAFO, and in light of DNR?s demonstrated inability to pay a larger civil penalty, DNR will pay a civil penalty of $6,431. The CAFO also includes the conditions that DNR will no longer manufacture, sell, or install defeat devices; will eliminate its existing inventory of defeat devices; and will offer to restore the original emission control equipment on any vehicles that DNR had modified with defeat devices in violation of the CAA.
