The distribution or sale of an unregistered pesticide which fails to meet the requirements set forth under 40 C.F.R. ? 152.30, including the importation of such pesticide, is an unlawful act under Section 12(a)(1)(A) of FIFRA, 7 U.S.C. ? 136j(a)(1)(A). King Technology Inc. failed to submit the NOA for Entry Number 691-02227886 prior to its May 6, 2022, arrival into the United States, as required by Section 17 of FIFRA and 19 C.F.R. ? 12.112(a). Failure by King Technology Inc. to submit an NOA prior to the arrival of unregistered pesticide, Chlorine Plus into the United States, is a violation of Section 12(a)(2)(N) of FIFRA, 7 U.S.C. ? 136j(a)(2)(N).
