On 04/28/2022 Region 5 mailed a Notice of Warning to Recon Technologies, LLC. In it Region 5 states that U.S. Environmental Protection Agency has reason to believe that you are in violation of Section 7(c)(1) of the Federal Insecticide, Fungicide and Rodenticide Act, as amended (FIFRA or the Act), 7 U.S.C. ? 136e(c)(1) and the regulations at 40 C.F.R Part 167, Subpart E, by failing to submit to the EPA the Pesticides Report for Pesticide-Producing Establishments (EPA Form 3540-16) (hereafter referred to as the ?Report?) for calendar year 2021, on or before March l, 2022. Section 12(a)(2)(L) of FIFRA, 7 U.S.C. ? 136j(a)(2)(L), states that it is unlawful for any person who is a producer to violate any of the provisions of Section 7 of the Act.
