Case summary
Region 5 alleged violations of Sections 203(a)(3)(A) and (B) of the CAA. Dependable Diesel removed or rendered inoperative devices or elements of design that were installed on heavy duty diesel-engine trucks, and sold, offered to sell, and/or installed parts and/or components necessary to defeat the emission controls and emission-related elements of design on heavy duty diesel-engine trucks. Dependable Diesel will return to compliance any vehicles and engines that it owns or operates; destroy or return to the manufacturer settings all defeat devices in its inventory and/or possession; remove from webpages and any social media all information that relates to performing tampering and/or selling defeat devices; and notify customers in writing about this settlement. Based on ATP analysis, Region 5 determined an appropriate civil penalty is $3,000.
