Case summary
Region 5 alleged that, in violation of Sections 203(a)(3)(A) and (B) of the CAA, 42 U.S.C. ?? 7522(a)(3)(A) and (B), Jackson Motors removed or rendered inoperative devices or elements of design that were installed on HD diesel-engine trucks, and that Jackson sold, offered to sell, and/or installed parts and/or components necessary to defeat the emission controls and emission-related elements of design on HD diesel-engine trucks. We discovered these violations by issuing a Section 208 information request on May 6, 2020. As recommended by the Region 5 Mobile Source Cases - Resource Allocation for AECAB and ORC Memo, R5 pursued an Expedited Settlement Agreement (ESA) as the number of tampered vehicle/engines (as well as other factors) meet the requirements for an ESA. Jackson Motors signed the ESA within the required 30 days from receipt of the ESA and paid the required penalty of $25,848 on August 23, 2021.
