Case summary
Between January 1, 2017 and May 6, 2020, Porter sold and/or installed exhaust gas recirculation block plates and electronic control module tuning products capable of bypassing, defeating, and/or rendering inoperative emissions control devices on at least 33 vehicles/engines. We discovered these violations by issuing a Section 208 information request on May 6, 2020. Region 5 issued a FOV to Porter Truck Sales on November 2, 2020. As recommended by the Region 5 Mobile Source Cases - Resource Allocation for AECAB and ORC Memo, R5 pursued an Expedited Settlement Agreement (ESA) as the number of tampered vehicle/engines (as well as other factors) meet the requirements for an ESA. Porter signed the ESA within the required 30 days from receipt of the ESA and paid the required penalty of $36,036 on June 16, 2021.
