Case summary

EPA alleged in a March 18, 2019 Notice of Violation (NOV) that Cardinal FG Company, Menonomie, Wisconsin, had made a major modification to its facility, increasing NOx emissions by a significant amount, without complying with the Prevention of Significant Deterioration requirements in the Wisconsin State Implementation Plan. The facility is located in Dunn County, Wisconsin, which has been designated as attainment or unclassifiable for NOx, ozone, and PM2.5. NOx is a precursor to ozone and PM2.5. Cardinal has agreed to enter into an Administrative Consent Order (ACO) which requires Cardinal to complete installation of a selective catalytic reduction system (SCR) which will control NOx emissions from the glass furnace. Cardinal must also update its permit to incorporate a limit of 2.0 pounds of NOx per ton of glass produced, on a 30-day rolling average. Cardinal will also be entering into a Consent Agreement and Final Order (CAFO) which will require Cardinal to pay a penalty of $99,500. The ACO and CAFO address and resolve the violations alleged in the March 18, 2019 NOV.
