Case summary
EPA alleged that Gopher failed to maintain negative pressure at a total enclosure and installed wind guards on the pressure gauges, preventing the exterior pressure gauges from collecting representative data. EPA also alleged that Gopher failed to demonstrate continuous compliance with total hydrocarbon and dioxin and furan emissions standards by not maintaining a minimum natural gas flow rate at furnaces. Finally, EPA alleged that during a performance test Gopher failed to collect the minimum sample volume when demonstrating compliance with lead emission standards. As the appropriate injunctive relief has already been implemented by Gopher, there is no concurrent administrative consent order. This CAFO requires Gopher to pay a penalty of $110,000 and resolves the violations set forth in the NOV/FOV issued to Gopher on November 25, 2015.
