Case summary

The Consent Agreement and Final Order (CAFO) for BP Products North America Inc. (BP), Whiting, Indiana addresses violations of the New Source Performance Standard for Equipment Leaks of VOC in the Synthetic Organic Chemicals Manufacturing Industry for Which Construction, Reconstruction, or Modification Commenced After November 7, 2006, codified at 40 C.F.R. Part 60, Subpart VVa; and Standards of Performance for Equipment Leaks of VOC in Petroleum Refineries for Which Construction, Reconstruction, or Modification Commenced After November 7, 2006, codified at 40 C.F.R. Part 60, Subpart GGGa. BP also violated its Title V operating permit at its Whiting, Indiana facility. Specifically, from January 1, 2016 through June 30, 2019, BP identified a total of 191 open-ended lines or valves that BP failed to cap, plug, second valve, or blind flange as required by 40 C.F.R. ? 60.482-6a(a)(1) and its Title V permit, Condition F.9.3(7). We discovered these violations through reviewing Title V permit deviation reports provided by Indiana Department of Environmental Management, and consent decree reports. EPA and BP have agreed upon a civil penalty of $286,500. The CAFO addresses the violations set forth in the Finding of Violation issued to BP on March 19, 2020.
