Case summary

The City of Midland is a municipal solid waste landfill in Midland, MI. EPA inspected the landfill and performed surface emission monitoring in May 2018. Upon finding surface emission exceedances, EPA followed up with an information request in August 2018. EPA reviewed the November 2018 response to this request and found a number of violations in addition to those exceedances in the inspection. EPA issued a Finding of Violation in May 2019 alleging violations of the Landfill NSPS and NESHAP and the NSPS and NESHAP General Provisions. Through negotiations, EPA and Midland have agreed to a compliance order requiring the addition of 8 new gas collection wells and a revised surface emission monitoring plan. No penalty is being assessed in this action.
