Case summary
Kalsec Inc. operates a manufacturing facility in Kalamazoo, Michigan (the Facility) that processes spices, herbs, and hops to produce oleoresins, essential oils, and miscella. EPA alleged that the Facility was subject to the National Emission Standards for Hazardous Air Pollutants for Miscellaneous Organic Chemical Manufacturing (Miscellaneous Organic NESHAP or MON) and had failed to comply with all applicable requirements of the MON since May 10, 2008. EPA is concurrently issuing a CAFO which requires Kalsec Inc. to pay a penalty of $75,000. This ACO requires Kalsec, Inc. to apply for a permit with the Michigan Environment, Great Lakes, and Energy limiting emissions of individual HAPs to less than 10 tons per year and total HAPs to less than 25 tons per year and addresses the violations set forth in the FOV issued to Kalsec, Inc. on August 13, 2015. This requires implementation of a LDAR program.
