Case summary

Region 5 issued a Finding of Violation (FOV) to Heidtman Steel on January 22, 2018 alleging the facility failed to comply with the applicable provisions of the NESHAP for Steel Pickling - HCl Process Facilities and Hydrochloric Acid Regeneration Plants at 40 CFR Part 63, Subpart CCC (Pickling NESHAP), the NESHAP for Industrial, Commercial, and Institutional Boilers and Process Heaters 40 CFR Part 63, Subpart DDDDD (Boiler NESHAP), and the requirement to obtain a Title V operating permit because the facility's potential HCl emissions was greater than the HAP major source threshold of 10 tons/year. The ACO requires Heidtman Steel to update its pickle line scrubber system O&M plan, operate the pickle line scrubber in accordance with the new O&M plan, install, operate, and maintain monitors for scrubber pressure drop and makeup water flow rate, maintain appropriate operating and maintenance records, and submit a permit application to IDEM requesting a federally enforceable state operating permit pursuant to the Indiana SIP. These activities will address the violations set forth in the FOV issued to Heidtman Steel on January 22, 2018. A Consent Agreement and Final Order is resolving the civil penalty portion of this case. The total civil penalty amount is $75,820.
