Case summary

Kinder Morgan Liquids, LLC, has entered into an agreement with EPA to resolve two Notices of Violation (NOVs), issued subsequent to two separate EPA inspections at its gasoline terminals located at 930 Tennessee Ave, Cincinnati, Ohio, which was formerly owned by BP Products North America, Inc (BP). During each inspection, EPA measured volatile organic compound (VOC) gases as high as 8 ppm emitted from the center vent and from the top of the tank. The NOVs alleged violations of a provision of the Facility's PTIO which requires that BP (now Kinder Morgan Liquids) maintain all openings at Tank 016 in a closed position at all times, except during active gauging and/or sampling. As part of this settlement, Kinder Morgan Liquids agreed to perform an inspection and repair of Tank 016 to ensure compliance with this provision, and pay a penalty of $10,000.
