Case summary
This action involves the issuance of both a Consent Agreement and Final Order (CAFO) and an Administrative Consent Order (ACO), addressing violations of the Indiana State Implementation Plan (SIP) at Carmeuse Lime & Stone's Buffington Operation, 1 North Carmeuse Drive , Gary, Indiana (Carmeuse). Specifically, Carmeuse installed a hot face dam in Kiln 3 that resulted in a significant net increase of nitrogen oxide emissions (NOx). Carmeuse did not obtain the required Prevention of Significant Deterioration (PSD) permit for this modification or install Best Available Control Technology (BACT) until December 2016. The ACO requires Carmeuse to: (1) operate a custom-made low-NOx burner on Kiln 3 to meet BACT; (2) install, operate, maintain and certify a continuous emissions monitoring system (CEMS) to measure NOx emissions from Kiln 3; (3) meet a 5.2 lb NOx/ton of lime, 30-day rolling average limit; and (4) modify its Title V permit to reflect the ACO requirements. The implementation of this Order will result in 55 tons/year of NOx emissions reduction and addresses the violations set forth in the NOV issued to Carmeuse on September 24, 2014. The CAFO requires a payment of $50,000 in penalties.
