Case summary

EPA issued a Consent Agreement and Final Order (CAFO) on the April 5, 2019, resolving alleged violations of the Clean Air Act at Calumet Superior, LLC n/k/a Superior Refining Company LLC, Superior, Wisconsin (Superior Refining). EPA alleges that Superior Refining had improperly operated its flares emitting excess volatile organic compounds, including organic hazardous air pollutants, and therefore violated certain provisions of the National Emission Standards for Hazardous Air Pollutants, including the General Provisions in Subpart A. Superior Refining agreed to a penalty based on the Clean Air Act Stationary Source Penalty Policy of $25,000. Superior Refining has also agreed to perform a supplemental environmental project to replace an older diesel school bus with a new propane bus for the Superior School District at a cost of no less than $75,000.
