Case summary

The Iroquois Bio-Energy Company, LLC (IBEC) operates an ethanol production facility in Rensselaer, Indiana. This settlement resolves violations related to venting volatile organic compounds (VOCs) and organic hazardous air pollutants (HAPs) in excess of applicable limits in violation of the facility's Federally Enforceable State Operating Permit. Specifically, EPA identified components on IBEC's fermentation process venting uncontrolled during a June 16, 2017 Inspection. EPA and IBEC agreed to a penalty based on the Clean Air Act Stationary Source Penalty Policy of $119,900. IBEC has also taken corrective action to remedy these violations and return to compliance, including the repair of components found venting on top of their fermentation process. IBEC has also agreed to increased monitoring and maintenance of these components and related pollution control equipment.
