Case summary

This CAFO commences and concludes a proceeding to resolve alleged violations of the New Source Performance Standards for Municipal Solid Waste Landfills, 40 C.F.R. Part 60, Subpart WWW (Landfill NSPS), corresponding provisions of the National Emission Standards for Hazardous Air Pollutants: Municipal Solid Waste Landfills, 40 C.F.R. Part 63, Subpart AAAA (Landfill NESHAP), and Environtech's Clean Air Act Title V permit. EPA alleged that between 2015 and 2017, Environtech failed to timely correct wellhead oxygen exceedances at its Morris, Illinois landfill. EPA notified Illinois EPA of this enforcement action on May 2, 2018, and Illinois EPA did not object to EPA taking enforcement action in this matter. In early 2018, following discussions with EPA, Environtech removed or replaced the wells which had exhibited oxygen exceedances. Environtech certifies that it is in compliance with the Clean Air Act's Landfill NSPS, the Landfill NESHAP and Environtech's Title V permit. The CAFO requires Environtech to pay a civil penalty of $33,930.
