On September 28, 2018, Region 5 entered into a Consent Agreement and Final Order (CAFO) and an Administrative Consent Order (ACO) with Falcon Foundry Company (Falcon Foundry) of Lowellville, Ohio. Under the ACO, Falcon Foundry has agreed to make operational changes to return to compliance with the Subpart ZZZZZZ requirements, including the installation of covers on furnaces; operating pursuant to approved written management practices plans; submitting both an Initial Notification and a Notification of Compliance Status to EPA; keeping records; and submitting deviation reports to EPA. The CAFO requires Falcon Foundry to pay a civil penalty of $10,000.
