Case summary

Leica Biosystems Richmond Inc. (Leica), located in Richmond, Illinois was issued of Notice of Violation/Finding of Violation (NOV/FOV) on September 28, 2016 alleging violations of the Clean Air Act. The NOV/FOV alleges violations of the Illinois State Implementation Plan (SIP). Leica exceeded the volatile organic compound (VOC) emission limit established in Section 212.301 of the Illinois SIP because Leica's dispensing of xylene products (a hazardous air pollutant and photochemically reactive VOC) caused emissions of xylene at rates of greater than eight pounds per hour. Leica's dispensing of xylene products has the potential to emit xylene at a rate higher than 10 tons per year, which triggered the requirement that Leica obtain a federally enforceable permit under Title V of the Clean Air Act. Leica also failed to operate organic material blending tanks with submerged loading pipes, as required in the Illinois SIP at 35 Ill. Admin Code Section 218.122. The ACO requires Leica to install, use and maintain submerged loading pipes on all of its blending tanks, cease dispensing of xylene and to modify its operating permit.
