Case summary

EPA has entered into a Administrative Compliance Order (ACO) with Midwest Marine Terminals, Chicago, Illinois to address violations regarding allegations in a September 19, 2017, Notice of Violation (NOV). The NOV alleged violations of the Illinois State Implementation Plan (SIP) for not controlling dust from the facility to ensure it does not cross the property line, resulting in violations of the IL SIP Rule 212.301. Additionally, Midwest Marine Terminals was not controlling fugitive dust from the roadways and other traffic areas. Region 5 discovered these violations during an unannounced inspection of the facility, along with an inspector from the City of Chicago. EPA and the City of Chicago inspector witnesses significant amounts of fugitive dust being generated from roadways, as well as witnessed dust crossing the east and west property lines. This ACO develops an enhanced fugitive dust plan, and requires various best management practices for controlling fugitive emissions from bulk solid storage handling facilities.
