EPA Region 5 and the Respondents entered into an Administrative Order on Consent (AOC) under Section 309(a) of the CWA resolving EPA's claims that Respondents violated Section 301 of the CWA, 33 U.S.C. ? 1311. Respondents channelized five different stream reaches resulting in the loss of 3,791 linear feet of stream on properties located in St. Clair County, Illinois without a permit. In the Administrative Order on Consent, Respondents agree to conduct stream mitigation activities along 5,660 linear feet of Little Silver Creek to compensate for lost functions on the five channelized stream reaches. The mitigation plan will be initiated in the summer of 2018 and completed by the end of the calendar year.
